Bidders registering to bid at Tommy Nolley Auction Service / PACO agree to the following terms & conditions of sale. A. BIDDERS NUMBERS: Bidders must register prior to bidding. There is no obligation or fee to register. When you bid on an item you have entered into a contract to purchase that item if you are high bidder. The auction staff have bidder numbers and may bid on items they wish to purchase. Absentee bids can be made by filling out the "Absentee Bid Form". Absentee bidders must follow the rules of the "Absentee Bidders Agreement" which is posted outside the office. Tommy will be bidding for the absentee bidders. B. GUARANTEE & INSPECTION: All items are sold "AS IS WHERE IS". There are no warranties expressed or implied, including but not limited to warranties of merchantability of fitness for a particular purpose. There is no guarantee or warranty as to the authenticity of the merchandise, neither shall any description (oral or written) of condition, size, quality, rarity, importance, be deemed a guarantee. Bidders should inspect merchandise themselves to determine the condition. We do our up most to inform our customers of flaws we have found prior to or at bidding time. All sales are final; merchandise is not sold on approval. C. DECLARATION OF SALE: All items are sold to the highest bidder as declared by the auctioneer. The auctioneer has the right to reject any bid, to advance the bidding at the auctioneer's discretion, and limit qualities on items sold by "Choice" selection. In the event of tie bids, bidding is reopened to all bidders. Some merchandise may be subject to a reserve bid. The reserve bid may be on the lot number tag or will be announced when that item is put up for bidding. D. PAYMENT: Payment can be made by cash, check (with proper ID) ($30.00 return check fee plus any expense), credit card (MasterCard - Visa - Discover) (card must be swiped). Payment must be made the day of the sale. There is a 10% buyer's premium added to all purchases. Sales tax will be addend to the sale price and the buyer's premium. Holders of a Texas or out of state tax permit must fill out a resale exemption form prior to paying out. E. PICK UP: Merchandise may be picked up after payment is made or Saturday after the sale from 11:00 AM to 12:59PM or the following Monday from 12 NOON to 2:00PM (call 512-926-1400 before you come on other days) and no later than Noon Friday following the sale. Merchandise not picked up by Friday Noon following the sale is considered abandoned and will be disposed of at the discretion of the auction company. Check the clerk ticket and the lot number tag on merchandise in order to ascertain that you are picking up the correct item(s), DO NOT USE A LIST YOU HAVE MADE FOR THIS PURPOSE. F. COMPLAINTS: Please direct complaints to Tommy (after the sale). If complaints cannot be resolved with us, you may direct your complaint to the Texas Department of Licensing& Regulations. The address and phone number for the Tx Dept of Lic. & Reg. is posted in the office. G. NO SMOKING IN THE AUCTION HOUSE!!
